Who I Am

Legal bases (PIPEDA & similar)
I collect, use, and disclose personal information with your knowledge and consent for the stated purposes, or as otherwise permitted/required by law (e.g., fraud prevention, tax). Where EU/UK/Swiss laws apply, my bases include contract, legitimate interests, and consent (for marketing/cookies).

Service providers (processors)
I use reputable vendors under contracts that limit their use of your data:

  • Google Workspace (Gmail/Drive) for email/document storage.

  • Dubsado for proposals, contracts, scheduling, client portal.

  • Stripe for card payments and invoices.

  • Website tools (hosting, form tool, basic analytics).

These providers may process data outside Canada. For EU/UK/Swiss data, Google’s Standard Contractual Clauses and similar safeguards apply.

International transfers
If you are in the EU/UK/Switzerland, your data may be transferred to countries without the same data-protection laws. I rely on contractual safeguards (SCCs) with my providers. You can contact me for more details.

Retention

  • Styling information (measurements/preferences/photos): kept 12 months from project completion (to support repeat services), then deleted or anonymized.

  • Business records (contracts, invoices, receipts): kept 6 years after the end of the tax year, as required by law.

I may retain information longer if required to resolve disputes or comply with law.

Your choices & rights

  • Access/Correction: request a copy or correction of your personal information.

  • Withdraw consent / deletion: you may withdraw consent or ask for deletion; I'll comply unless I must keep some data (e.g., tax records).

  • Marketing: opt out of marketing at any time (unsubscribe link or [email protected]).

  • Cookies: control non-essential cookies via your browser or my banner (see Cookies).

  • Complaints: contact me at [email protected]. You may also contact the Office of the Privacy Commissioner of Canada.

Security
I use reasonable safeguards (access controls, encryption in transit, least-privilege access) and review vendors for security posture.

Breach notification
If I become aware of a breach creating a real risk of significant harm, I will notify affected individuals without undue delay and, where required, regulators, and maintain breach records.

This Site is operated by Khrystyna Nahorna, operating as “CHRIS\BIRDY.” By accessing or using chrisbirdy.com, you agree to these Terms. If you book services, your booking is also governed by the Client Service Agreement you sign at the time of booking.

Website use & acceptable conduct
Use the Site only for lawful purposes.
Do not:

  • attempt to access non-public areas or interfere with security;

  • upload or transmit malware, spam, or abusive content.

Booking & payments (summary)
Website checkout, proposals, contracts, and invoices are processed via trusted providers (e.g., Dubsado, Stripe). Specific commercial terms (scope, fees, deposit, balance, rescheduling/cancellation, refunds) are governed by the Client Service Agreement presented at booking. In case of conflict, the Client Service Agreement prevails for your project.

No professional guarantees
Personal styling is inherently subjective; outcomes vary. Nothing on the Site is a guarantee of results. (Your project terms, including limitations of liability, are in the Client Service Agreement.)

Limitation of liability
To the maximum extent permitted by law, I am not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site. My total liability for Site-related claims will not exceed CAD $100. (Project work is governed by the liability terms in your Client Service Agreement.)

Privacy
Your use of the Site is also subject to our Privacy Policy. By using the Site, you consent to the privacy practices and use of service providers (including cross-border processing with safeguards).

Governing law & venue
These Terms are governed by the laws of Ontario, Canada, and disputes will be brought in the courts located in Toronto, Ontario.
